In contrast to the sombre mood during the contrived gubernatorial rerun election in Osun State late last year to facilitate rigging, gaiety and conviviality was observed in Osogbo the capital city as the tribunal looking into the petition of PDP’s Ademola Adeleke against the declaration of Gboyega Oyetola as governor of Osun state ruled that INEC’s act was null and void.
The Tribunal further ruled that the
petitioner, Senator Ademola Adeleke scored majority lawful votes and therefore should be declared the State governor, while the certificate of return issued to Gboyega Oyetola, a nephew of South West regional political strongman, Bola Ahmed Tinubu be withdrawn.
The Tribunal made the declaration on Friday after dismissing a preliminary objection against the petition of the PDP and Senator Adeleke challenging the September 2018 governorship election in the state.
The preliminary objection was filed by the All Progressives Congress (APC) and its candidate in the election, Governor Gboyega Oyetola, as well as the Independent National Electoral Commission (INEC).
The three defendants claimed that the petition of the PDP and its candidate was incompetent and the tribunal lacked jurisdiction to hear it.
Delivering a ruling on the preliminary objection, Justice Peter Oni who is a member of the three-man Tribunal held that the petition was competent.
He also stated that the Tribunal has the jurisdiction to hear and determine it.
The judge held that there was merit in the appeal filed by the PDP and Senator Adeleke, adding that the declaration and return of Governor Oyetola by INEC was null and void.
In reaction, Rev Emmanuel Arise broke into a dance, singing, “Osun is PDP as Senator Ademola Adeleke of the PDP has been declared the Governor of Osun State by the Election Petition Tribunal.
PDP now has two states in South West and Ekiti State is coming to make it three.”
In a statement by Osun State born former Aviation minister, Femi Fani-Kayode, it was
“Congratulations to Governor-elect Ademola Adeleke and the Osun State PDP on a great victory at the election tribunal. We have done it! My state, Osun State has finally gone PDP. I am overjoyed and overwhelmed. Praise the Lord! To Him alone be the glory!”
PDP chairman, Uche Secondus has offered his congratulatory message to Ademola Adeleke and equally hailed the judiciary for standing for truth in the face of intimidation and harassment.
The National Chairman also noted that the tribunal by their landmark ruling has helped to restore hope to Nigerians that all stolen mandates shall be recovered from the electoral robbers and returned intact to the rightful winners.
He commended the Judges for putting truth and justice ahead of any other matter in carrying out their professional responsibilities.
PDP also hailed Adeleke’s triumph at the Osun State Gubernatorial Tribunal by calling it a victory for democracy and the will of the people.
“The judgment is a clear indicator that those who set out to destroy our democracy can never triumph and that no matter how evil and injustice appear to thrive, the truth must always prevail at the end of the day.
Nigerians have accepted democracy as a way of life and a form of government that suits the multi-plurality of our nation.
The spontaneous jubilation that greeted this judgment is therefore a direct indication that it is in consonant with the wishes and aspiration of Nigerians across the board.
For those who have been desperate to destroy our democracy, this judgment has proven to them that their shenanigans will always come to no avail.
The PDP commends the judiciary for standing upright in the defence of democracy and for ensuring that those involved in the rapacious desecration of our democratic norms will never succeed.
This verdict, which reverberates across our nation, points to the fact that the truth will always prevail and that our party, the PDP, will recover all our stolen mandates in the 2019 general elections, particularly, the Presidential mandate, which Nigerians freely gave to our candidate, Atiku Abubakar.
Furthermore, all our candidates who have already won their elections, but whose victories are being manipulated by anti-democratic forces, must take solace in the words of the Osun election petition panel, that once valid votes have been declared and a winner emerges by majority of votes, a rerun is illegal.
