Dakum Floors Yilpwan, Emerges Authentic Labour Party Candidate In Plateau State At The Federal High Court

Dr. Patrick Dakum, affirmed by Federal High Court as the rightful Labour Party gubernatorial candidate for Plateau State.

In Suit number FHC/J/CS/76/ filed by Amb. Yohanna Margif Yilpwan against Labour Party, and two others challenging the candidature of Dr. Patrick Dakum as the authentic Governorship Candidate of the party in Plateau State ahead the 2023 General Election has been struck out by the Federal High Court sitting in Jos, Plateau State Division on Friday, 9th December, 2022.

 








The court ruled that the Plaintiff, Amb. Yohanna Margif Yilpwan lacked the locus standi to challenge the 2nd respondent, Patrick Dakum in the matter because he has never been a party to the said primary conducted by the Labour Party which produced Patrick Dakum.

Justice Dorcas Agishi of the Federal High Court, Jos stated this whilst delivering judgement in the suit between Yohanna Margif, Labour Party, Patrick Dakum and the Independent Nationa Electoral Commission (INEC) over who is the rightful candidate of the party for the State Governorship in the 2023 general elections.




Justice Agishi further ruled that the electoral law of 2010 has put to rest by throwing more light on the grey areas which said any candidate that didn’t take part in an election lacks the locus standi to challenge what transpired in that very exercise, and thus lacks the moral right to question the abnormalities that must have played out during the exercise.




Justice Agishi further said that the exhibit before the honorable court has not only proved, but indicated clear evidence that the plaintiff, Yohanna Margif Yilpwan resigned on his own accord and so he didn’t take part in the primary conducted under the watchful eyes of INEC which legalized the entire process.




She went further to state that even at the time under review, the plaintiff has been expelled from the party largely because his actions had continually dragged the name of the party into the mud as many untoward activities linked to Amb. Yohanna Margif had become very obvious.




The judge finally submitted that with the crystal clear evidence before the honorable court, it clearly showed that the suit filed by the plaintiff had become an afterthought and above all, grossly lacking in merit and was struck out.




The running mate to Dr. Dakum who doubled as Counsel in the matter, Edward Pwajok SAN, in an interview with journalists said the Judgement is a landslide Judgement.



He added that now that the court case is over, the party can now focus on an aggressive campaign with the view to winning the governorship election and other positions both in the state and presidential positions.




Pwajok however decried that there has been unseen hands in the whole of the court case because “we can not deny the fact that some powerful forces in government were involved”.




On his part the Counsel to the Plaintiff said they will study the Judgement with the aim of testing it further at the Appeal Court.
